Buying property as a foreigner
Condominiums
Foreign ownership in a registered condominium is generally limited to 49% of the total floor area of all units. Buyer eligibility and the available foreign quota must be checked.
Houses and land
Foreigners generally cannot own land directly, except under limited statutory exceptions. Residential leasehold arrangements are commonly used, with a maximum term of 30 years. Have the structure and any proposed renewal reviewed by a qualified Thai lawyer.
Legal due diligence
Arrange an independent legal review of the property, title documents and contracts before making a commitment.
Freehold or leasehold?
Choosing between freehold ownership and leasehold is an important consideration for foreign buyers in Thailand. Each structure has different rights and limitations, so it is worth understanding which option fits your plans.
Freehold means ownership without a fixed lease term. Foreign buyers can qualify to own condominium units within the foreign quota: no more than 49% of the total floor area of all units in the condominium.
Leasehold gives the right to use a property for an agreed period rather than ownership of the land. A residential lease is generally limited to 30 years. Any proposed renewal requires separate legal review and should not be treated as automatic ownership or a guaranteed 90-year term.
